Terms of Service
These terms govern use of Trovascout, a creator outreach product built and operated by CVPK Digital Studio LLC, a New York limited liability company ("CVPK," "we," "us"). By creating an account or using Trovascout you agree to these terms on behalf of yourself and, if you are signing up for an organization, on behalf of that organization ("you," the "customer").
1. What Trovascout does
Trovascout searches public creator profiles, scores what it finds against the brief you provide, and shows you a board of candidates with whatever contact information it could locate. You write or approve the outreach message, and you review and confirm each batch before anything goes out. Once you confirm, Trovascout sends the message for you, through the mailbox you connected under your own account, and tells you what happened to it: whether it went out, bounced, was replied to, or the creator asked to be left alone.
2. Who decides what
You operate the Service. You choose which creators to contact, what your message says, when you send it, and what disclosures the arrangement requires, including any disclosure a creator you work with owes their own audience under applicable advertising law. Trovascout supplies the tool and the data behind it; it does not review or approve any individual campaign, message or piece of content.
3. Accounts
You are responsible for the accuracy of the information you give us when you sign up, for keeping your login credentials to yourself, and for everything that happens under your account. Tell us right away if you believe your account has been accessed without your permission.
4. Fees and billing
Paid plans are billed in advance on the schedule shown at checkout, through our payment processor. Where a trial is offered, the terms of that trial, including its length and what happens if you do not cancel before it ends, are stated at signup. Fees are stated in US dollars and are exclusive of applicable tax unless stated otherwise. A plan that is cancelled remains active, and billable, through the end of the period already paid for.
5. Your data, and data about creators
What we hold, how we use it and how a creator can ask to be left alone is described in full in our Privacy Policy, which is part of these terms.
6. Acceptable use
Your use of Trovascout is also governed by our Acceptable Use Policy, which is part of these terms. A material breach of that policy is a material breach of this agreement.
7. Intellectual property
CVPK owns Trovascout: the software, the scoring methods, the design and everything else that makes up the product. We grant you a limited, non-exclusive, non-transferable right to use it for your own business during the term of your subscription. You keep ownership of the content you write, the briefs you provide and the outreach messages you compose. You may export your own creator lists and records at any time, in either an active or a cancelled account.
8. Third parties
Trovascout relies on outside vendors to find creators, score them, host the product and send account related email. Those vendors, and what each one does, are listed in the Privacy Policy. Costs a vendor charges for a connection you bring yourself, under our bring-your-own-key model, are yours.
9. Regulated customers
Some customers operate in regulated categories. For those customers the standard terms on this page are not the whole arrangement: a regulated customer's use of Trovascout is subject to a separate, negotiated agreement in addition to these terms. If that describes you and no such agreement is in place, contact us before you sign up.
10. Termination
You may cancel at any time from your account. We may suspend or terminate an account for a material breach of these terms, the Acceptable Use Policy, or applicable law, and will tell you why when we do, except where telling you would itself create a legal or safety problem.
11. Disclaimer of warranties
Trovascout is provided as is. We do not guarantee that any creator we surface will respond, that any contact information we find is current, or that the product will be free of errors or interruptions. Public profile data changes constantly and is outside our control.
12. Limitation of liability
To the maximum extent the law allows, CVPK is not liable for indirect, incidental or consequential damages arising from your use of Trovascout, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
13. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules.
14. Changes to these terms
We may update these terms as the product changes. A change to the words of this page moves the version date at the top and the bottom of it; a change to how the page looks does not. Continued use of Trovascout after a words change means you accept the update.
